These terms and conditions apply to the VociCards app (hereby referred to as "Application") for mobile devices, created by Oleksandr Miroshnychenko (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

1. Intellectual Property

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

2. Artificial Intelligence (AI) Features

The Application utilizes AI technologies (including Google Gemini) to provide translation services, content generation, and vocabulary enrichment. By using the Application, you acknowledge and agree that:

  • AI-generated content may be inaccurate, incomplete, or outdated. We do not guarantee the correctness of translations or learning materials.
  • The Service Provider is not responsible for any direct or indirect damage resulting from your reliance on AI-generated content.
  • Ownership of AI-generated output created for you belongs to you, provided you comply with these Terms; however, you grant the Service Provider a non-exclusive license to process such data to deliver the Service.
  • We utilize both Free and Paid tiers of AI service APIs for all users (including both free and paid subscription accounts). Consequently, your input data, queries, and interactions with AI-powered features may be processed using services where Google may use the data for analysis, service improvement, and model training.

3. Educational Disclaimer

VociCards is designed as an educational tool to support language learning. The Application does not guarantee any specific learning outcome, level of language proficiency, or examination result. Learning effectiveness depends on individual effort, consistency, and prior knowledge.

All vocabulary content, example sentences, and mnemonics provided in the Application are for educational purposes only. The Service Provider makes no representations about the suitability of this content for any specific professional, legal, or medical purpose.

4. Subscriptions and Payments

The Application is provided as a Freemium service. While basic features are free, certain premium features and content may require a paid subscription or one-time purchase.

  • Subscriptions and in-app purchases are processed through the official app stores (Apple App Store or Google Play Store).
  • Billing, cancellations, and refunds are subject to the terms and conditions of the respective app store provider (Apple or Google).
  • The Service Provider reserves the right to change pricing or features included in subscriptions at any time. Changes will be communicated clearly to users in advance.

5. User Responsibilities

It is your responsibility to maintain the security of your device and access to the Application. We strongly advise against jailbreaking or rooting your phone, as it may expose your device to security vulnerabilities and cause the Application to malfunction or lose functionality. You are also responsible for all data charges incurred from your mobile network provider while using the Application.

6. Prohibited Conduct

You agree not to use the Application to:

  • Generate or share any content that is illegal, harmful, threatening, abusive, or offensive.
  • Attempt to interfere with, disrupt, or reverse-engineer the technical infrastructure of the Application.
  • Use automated systems (bots, scrapers, or crawlers) to extract data from the Application without prior written permission.
  • Impersonate another person or misrepresent your identity or affiliation.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Application. In no event shall the Service Provider's total liability to you exceed the amount you paid for the Service during the 6 (six) months preceding the event giving rise to the liability. If you are using the free version of the Application, the Service Provider's total liability is limited to $0.00.

8. Termination

The Service Provider may terminate or suspend your access to the Application at any time, with or without cause, and with or without notice. Upon termination: (a) the rights and licenses granted to you under these Terms will end; (b) you must cease all use of the Application and delete it from your device.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Ukraine.

10. Changes to These Terms

The Service Provider may periodically update these Terms and Conditions. You will be notified of any material changes by the posting of the new Terms on this page and, where appropriate, through an in-app notification. Continued use of the Application after changes are posted constitutes your acceptance of the updated Terms. These terms are effective as of 2026-04-06.
